Fortune for your free initial consult.  (401) 782-2300. email@attorneyfortune.com.  Hello, want to learn about Rhode Island Child Custody?  In 1966, the Rhode Island Supreme Court held that child-custody awards must be made in the "best interest(s) of the child" Petition of Loudin, 101 R.I. 35, 39, 219 A.2d 915,918 (1966).   It was not until 1990 in (Pettinato v. Pettinato, 582 A.2d 909 (R.I. 1990), that the Rhode Island Supreme Court issued identifiable factors which must be weighed by a Judge when conducting a best interest of the child analysis.  In Pettinato the Rhode Island Supreme Court detailed eight (8) best interest of the child factors for the trial justice to analyze when determining custody, placement, and parenting time.  Here are the eight (8) facts that will be analyze by your Rhode Island Family Court Judge.  The wishes of the child's parent or parents regarding the child's custody.  the reasonable preferences of the child, if the court deems the child to be of sufficient intelligence, understanding, and experience to express a preference.  The interaction and interrelationship of the child with the child's paren or parents, the child's siblings, and any other person who may significant affect the child's best interest.  The child's adjustment to the child's home, school, and community.  The mental and physical health of all individuals involved.  The stability of the child's home environment.  The moral fitness of the child's parents.  The willingness and ability of each parent to facilitate a close and continuous parent-child and the other parent.  It is very important to know that your Judge will not determine the best interests of the child by assessing any one factor.  The trial justice must consider a combination of and an interaction among all the relevant factors that affect the child's best interest.
